The Derby City Council approved an ordinance establishing permanent water restrictions at the Sept. 9, 2025 meeting. Permanent restrictions were recently approved by the City of Wichita, and as a wholesale purchaser of water from Wichita the City of Derby must contractually follow suit in passing regulations. The permanent water restrictions passed are always in place except when the City is in further drought emergency restrictions. The ordinance relates to lawn sprinkler/spray irrigation devices used to water lawns. It establishes permanent watering restrictions for the City in support of long-term water conservation measures. The new regulations go into effect Monday, September 15 and include the following: 

Outdoor watering is allowed only on Tuesday, Thursday and Saturday before 10 a.m. and after 6 p.m. 

No watering allowed any day of the week between 10 a.m. and 6 p.m. (heat of the day).  

Hand watering and other outdoor water use (such as pool filling) is allowed any day, outside of 10 a.m. to 6 p.m. timeframe. 

Private well water use is exempt from the restrictions. 

Variances may be requested to allow for things such as overseeding or sodding that may require a limited time period of daily watering. An online application is available at derbyks.gov/varianceapplication. 

Please adjust outdoor irrigation systems and set them to the proper watering days and times. 

The City will work to educate people over the next few weeks before violations occur. 

Violations will be treated similar to drought restriction violations. There will be a warning, $50 fines, and then $100 fines for third violations and beyond.
